ESDC updated processing times for LMIA applications

September 13, 2023

times for LMIA applications

On September 12, 2023, Employment and Social Development Canada (ESDC) updated the processing times for LMIA applications under various streams. Based on statistics from all processing centers, the current average LMIA processing times have increased for the Seasonal Agricultural Worker Program, In-home caregivers, and High-wage Stream.

How LMIA Processing Affects Work Permits

Once an LMIA is issued, the foreign worker can apply for a work permit. Delays in LMIA approval, however, can have a direct effect on work permit applications, leading to unwelcome disruptions in employment arrangements.

LMIA process steps

Labour Market Impact Assessment (LMIA) is an essential process for employers in Canada wishing to bring foreign workers to work in the country. The process consists of various steps to determine whether employing a foreign national would adversely affect Canadian job applicants.

To start with, the employer should prove they made real efforts to find suitable Canadians to work before requesting an LMIA from Employment and Social Development Canada (ESDC). The employer must provide evidence of recruitment efforts, information on the job offer, and adherence to wages and working conditions.

After submitting the application, ESDC examines the application, evaluating labor market needs. If the application is approved, the employer gets a positive LMIA, which enables the foreign worker to apply for a work permit. Times for LMIA applications

The process may take weeks, depending on the type of LMIA and the location of the job. To make the process efficient and enhance chances of approval, the use of immigration experts is greatly suggested.

What is a Labour Market Impact Assessment (LMIA)?

Before hiring a foreign worker, a Canadian business may be required to get a Labour Market Impact Assessment (LMIA). A positive LMIA will demonstrate that a foreign worker is required to fill the position. Additionally, it will demonstrate that no Canadian citizen or permanent resident is qualified for the position. A confirmation letter is another name for a positive LMIA.

The worker can submit a work permit application after the employer receives the LMIA.

Applicants for work permits must meet the following requirements:

  • A Job Offer Letter,
  • A Contract,
  • A Copy of The LMIA,
  • The LMIA Number
What is the LMIA for ESDC?

The Labour Market Impact Assessment (LMIA) is an important document released by Employment and Social Development Canada (ESDC) which decides if the recruitment of a foreign worker will positively or neutrally affect the Canadian labor market. Foreign talent must be hired by Canadian employers first after they acquire an LMIA to demonstrate that there is no suitable Canadian citizen or permanent resident who can be recruited for the job. A positive LMIA, also referred to as a confirmation letter, enables the foreign worker to obtain a work permit. The process entails showing good faith efforts to hire locally, paying competitive wages, and being in compliance with Canadian labor laws. For companies seeking to grow with foreign skilled professionals, obtaining an LMIA through ESDC is a strategic decision that improves workforce quality and fuels growth. Times for LMIA applications
