Saskatchewan Charges Regina Trucking Employer Under Saskatchewan Immigration Legislation

Saskatchewan immigration legislation

Saskatchewan immigration legislation remains relevant for the maintenance of the integrity of the province’s immigration system as there have been charges laid against a Regina-based transportation employer for violation of the province’s foreign worker recruitment legislation.

It should be noted that Escalade Transportation Inc. and Hafiz Tariq Ayub have been charged with three counts under section 22 of The Foreign Worker Recruitment and Immigration Services Act, 2013. It is noteworthy that the offences are associated with incidents that occurred in Escalade Transportation Inc. of Regina, Saskatchewan from November 2022 to August 2023.

Why Is This Important for Foreign Workers?

For individuals seeking employment in Saskatchewan, this is an indication of how necessary it is for one to be aware of employment eligibility requirements and Saskatchewan immigration legislation prior to accepting any job offer from Canada.

Foreign workers have various ways to immigrate into Saskatchewan through different federal or provincial immigration streams based on an individual’s status, profession, credentials and future objectives. Saskatchewan immigration also has SINP and other federal immigration streams that might be relevant for certain foreign workers.

Presently, Saskatchewan legislation has established protections for foreign nationals employed, seeking employment, or undergoing the immigration procedure in Saskatchewan. These include foreign workers, students, visitors, permanent residency applicants and foreign nationals undertaking self-employment.

Saskatchewan Immigration Services Act: What Changed?

Another significant aspect of the recent development in this area is the amendment in the Saskatchewan immigration legislation.

The Immigration Services Act took effect on July 1, 2024, replacing the 2013 legislation known as The Foreign Worker Recruitment and Immigration Services Act. This new legislation centralized immigration-related regulations into one legislative framework and enhanced monitoring of the employers, foreign worker recruiters, and immigration consultants.

The current legislation framework has been created with the intention of providing program integrity, ensuring that foreign workers and employers of Saskatchewan are protected and their interests are met.

Employers who hire foreign workers have to get registered and a Certificate of Registration before hiring any foreign workers according to the Saskatchewan requirements.

Protection for Foreign Workers in Saskatchewan

The current Saskatchewan immigration laws, such as the Immigration Services Act, offer protection to foreign workers. Saskatchewan maintains that there is a responsibility by employers, immigration consultants, and recruiters to ensure that immigrants and foreign workers receive fair, honest, and respectful treatment.

This means that foreign workers need to have all the information about the nature of their employment offer, including job position, duties, salary, benefits, and other employment terms before making any immigration or employment decisions.

Working with a licensed immigration professional or a licensed foreign worker recruiter will assist in gaining an understanding of the immigration process. The government of Saskatchewan maintains information on licensed immigration consultants and foreign worker recruiters under current laws.

What Does This Means for People Planning to Work in Canada?

The Saskatchewan situation serves as a perfect illustration of the need for proper and adequate information when it comes to making decisions about immigration and employment. The legislation regulating immigration in the province provides for the possibility of determining the rights and obligations of employers and foreign workers.

Those foreigners who are interested in immigrating to Saskatchewan will be able to find out which options are available for them according to their situation by studying the legislation. Learning about the criteria for obtaining a work permit or applying for permanent residence would allow applicants to take the necessary steps regarding their immigration to Canada.

Employers, on their part, also have to know the requirements of the provincial registration and the obligations they have to fulfill when hiring foreign workers.

Plan Your Saskatchewan Immigration Journey Carefully

Opportunities abound for skilled international workers to work in the province, but more importance is being attached to transparency and compliance by the Saskatchewan immigration legislation that governs them.

Those who wish to apply for a Saskatchewan work permit, SINP, Canadian residency or other opportunities for foreign workers will need to understand the requirements that govern them and seek professional assistance if necessary.

As immigration requirements are always changing, keeping track of Saskatchewan immigration legislation can help the prospective immigrant and employer to better prepare.
